The website www.louiseetgab.fr offers for sale, in France and abroad, the products of Louise&Gab.
These Terms and Conditions of Sale govern the use of the Site and of its associated services. When placing an order, upon creating their account, the Customer acknowledges having read and accepted them by ticking the box “I fully accept the Terms and Conditions of Sale”. In the event of changes, the applicable terms and conditions of sale are those in force on the date the services are used or the order is placed.
Article 1: Products
The essential characteristics of the products are presented on the Site on each product page. The Customer is fully informed that the colours shown on screen may not exactly match the actual colours, for reasons related to the web browser and software used.
Products offered for sale on the Site are available while stocks last.
Article 2: Orders
In accordance with the French law of 13 March 2000 on electronic signatures, any order form validated by the Customer by “double click” constitutes an irrevocable acceptance, which can only be called into question in the event of “out of stock” or by exercising the “right of withdrawal”.
If the items ordered are no longer available, the Customer will be informed by email; Louise&Gab will offer a credit note or a refund within fifteen (15) working days.
Article 3: Registration
When placing their first order, the Customer creates an account in which they enter the information needed to process it. They must fill in the information form correctly and update it where necessary. Louise&Gab cannot be held liable for a delay or failure in shipping resulting from incorrect information. The Customer must provide an email address and a password to access their account. They are solely responsible for keeping their password confidential and for the proper use of their personal account. They must log out after each use.
Article 4: Prices
The prices of the products sold on the Site are shown per item and in euros. They include all French taxes (VAT included) and exclude shipping costs, which are payable by the Customer. Customs duties and any taxes payable on receipt in certain countries are not included in the prices and are payable by the Customer. Prices may be changed by the seller at any time without notice, in particular in the event of changes in tax or economic conditions.
Article 5: Payment terms
Online payment is made exclusively through Stripe, a payment service provider. The Customer is redirected to Stripe’s secure payment page, where they enter their card details directly; Louise&Gab never has access to these details and does not store them. The accepted payment methods (bank card in particular) are shown on that page. Stripe is certified PCI DSS Level 1.
Louise&Gab retains full ownership of the products sold until the sums due by the Customer have been received.
Louise&Gab reserves the right not to fulfil an order from a Customer with whom it is in dispute over the payment of a previous order.
The shipping time is calculated from the date of payment.
Article 6: Order confirmation
The Customer accepts that the invoice is considered as proof of the contractual relationship between them and Louise&Gab.
The invoice is sent to the Customer at the email address given when ordering. Louise&Gab accepts no liability for input errors made at that time.
Order forms and invoices are archived on a reliable medium and may be reproduced as evidence.
Article 7: Shipping
Every order placed on the Site is shipped within 2 working days, or within ten working days at most during busy periods (Christmas, sales). If a delay is foreseeable, Louise&Gab will inform the Customer as soon as possible.
The preparation time is not included in the shipping time.
Orders within France are shipped by Colissimo. If the Customer is not at home, a collection notice is left by La Poste. The Customer then has 15 days to collect the parcel from the post office, with proof of identity. After this period, the parcel will be returned to Louise&Gab, who will contact the Customer to arrange for it to be sent again.
Colissimo shipping rates are as follows:
Shipping costs: France: €5 (free shipping on orders of €69 or more); Europe: €10; rest of the world: €25.
Louise&Gab cannot be held liable for a delay or failure in shipping caused by inaccurate information provided when the order was placed. The cost of sending the order again will be borne by the Customer.
Louise&Gab cannot be held liable for shipping delays caused by the carrier. In the event of damage attributable to the carrier, the Customer must report it to Louise&Gab as soon as possible and no later than eight (8) working days after receipt.
If the product does not match the order placed on the Site, the Customer must make a complaint via the contact form no later than eight (8) working days after receipt; after this period, no complaint will be considered.
Any manufacturing defect must be reported via the contact form no later than eight (8) working days after receipt. The defective item will be replaced at Louise&Gab's expense. If the item has been damaged through wear and tear or abnormal use, it will not be repaired.
Any product to be exchanged or refunded must be returned to Louise&Gab, 162 rue de Vaugirard, 75015 Paris, in its original packaging and in perfect condition, no later than fourteen (14) days after receipt. Return costs will be borne by the Customer.
The terms and conditions of sale set out in the paragraphs above apply only to purchases made on the online shop www.louiseetgab.fr, and not to those made from our resellers.
Article 8: Intellectual property
Louise&Gab holds the intellectual property rights to the Site and the right to distribute the elements on it, in particular photographs and texts. Any partial or total reproduction of elements of the Site, on any medium whatsoever, as well as their use, is strictly prohibited.
Article 9: Liability
Louise&Gab is not responsible for computer bugs or problems accessing the Site and reserves the right not to fulfil an order resulting from an error, hacking or malicious act.
The personal data provided by the Customer on www.louiseetgab.fr is necessary to process their order and manage the customer relationship. Louise&Gab, as data controller, shares it only with the service providers needed to fulfil the order (payment: Stripe; shipping: La Poste / Colissimo; hosting of the Site) and does not sell it to third parties. It is kept for as long as necessary to manage the order and to meet legal obligations. In accordance with the General Data Protection Regulation (GDPR, Regulation (EU) 2016/679) and the amended French Data Protection Act of 6 January 1978, the Customer has the right to access, rectify and erase their data, to restrict or object to its processing, and to data portability, through the Site’s contact form. They may also lodge a complaint with the CNIL, the French data protection authority (www.cnil.fr).
Article 10: Right of withdrawal
For products purchased online, the legal withdrawal period is fourteen (14) clear days from the date of receipt (as evidenced by the postmark or the date on the proof of receipt). The Customer does not have to give reasons or pay penalties within this period. For personalised products, this period starts from the acceptance of the offer.
Return costs and risks are borne by the Customer, and partial or full refunds are made within fifteen (15) days of receipt of the goods by Louise&Gab. Items returned after the fourteen (14) day period, without their original packaging, or damaged, will not be taken back, exchanged or refunded.
Article 11: Applicable law and jurisdiction
These terms and conditions of sale are governed by French law. The invalidity of any clause shall not affect the validity of the others. Any dispute arising from their interpretation or performance shall fall under the jurisdiction of the courts within the district of the Paris Court of Appeal (France).
